This Privacy Policy explains how we collect, use, and (under certain conditions) disclose your personal information. Personal information is any combination of information, in the possession of or likely to come into the possession of iwi, that relates to a discrete individual (“Personal Information”) and will be treated in accordance with this Privacy Policy. This Privacy Policy also explains the steps we have taken to secure your personal information. Finally, this Privacy Policy explains your options regarding the collection, use, and disclosure of your personal information.
This privacy policy only applies to Personal Information collected via the Site. This privacy policy does not necessarily apply to any offline collection of your personal information. Please see below for details.
We are not responsible for the content or privacy practices on any web site not operated by Qualitas Health, Inc. to which the Site links or that links to the Site.
- INFORMATION COLLECTION AND USE
1.1. Purposes for collection, use, and disclosure of Personal Information.
We collect information from you in several different ways on this Site. One goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. More specifically, iwi collects, uses, and discloses your Personal Information (including individuals associated with you, all of whom are referred to as “you” in this Privacy Policy) in its normal course of business for the following purposes:

(f) Where you have requested a service from iwi, assisting you in the completion of your application, the assessment of your eligibility for any such requested service, the processing and maintenance of the service, as well as any applicable renewal of such service;
(g) Allowing our affiliated companies to notify you of certain products or services offered by our affiliated companies;
(h) Processing transactions through service providers;
(i) Meeting legal, security, processing and regulatory requirements;
(j) Protecting against fraud, suspicious or other illegal activities; and
(k) Compiling statistics for analysis of our sites and our business.
1.3. Kinds of Information we Collect.
(a) Registration and Ordering.
Before using certain parts of any Site or ordering products, you must complete an online registration or ordering form. During registration or ordering, you will be prompted to provide to us certain personal information, including but not limited to your name, shipping, and billing address(es), phone number, email address, and credit card number. In addition, we may also ask you for your country of residence and/or your organization’s country of operation, so we can comply with applicable laws and regulations, and for your gender. These kinds of personal information are used for billing purposes, to fulfill your orders, to communicate with you about your order and the Sites, and for internal marketing purposes. If we encounter a problem when processing your order, your personal information may be used to contact you.
(b) Email Addresses.
Several locations of the Site permit you to enter your email address for purposes including but not limited to: request us to notify you of new products; sign up for email newsletters and special offers.
(c) Cookies and Other Technology.
Like many sites, the Site employs cookies and web beacons (also known as clear GIF technology or “action tags”) to speed your navigation of the Site, recognize you and your access privileges, and track your Site usage.
(i) Cookies are small pieces of information that are stored as text files by your Internet browser on your computer’s hard drive. Most Internet browsers are initially set to accept cookies. You can set your browser to refuse cookies from websites or to remove cookies from your hard drive, but if you do, you will not be able to access or use portions of the Site. We have to use cookies to enable you to select products, place them in an online shopping cart, and to purchase those products. If you do this, we keep a record of your browsing activity and purchase.
(ii) Web beacons assist in delivering cookies and help us determine whether a web page on the Site has been viewed and, if so, how many times. For example, any electronic image on the Site, such as an ad banner, can function as a web beacon.
(iii) We may use third-party advertising companies to help tailor site content to users or to serve ads on our behalf. These companies may employ cookies and web beacons to measure advertising effectiveness (such as which web pages are visited or what products are purchased and in what amount). Information that these third parties collect via cookies and web beacons may be linked to personal information collected by us. As an example, Facebook collects certain information via cookies and web beacons to determine which web pages are visited or what products are purchased.
(iv) This Site does use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity, and providing other services relating to website activity and internet usage for iwi and its affiliates. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.
(v) The major browsers have attempted to implement the draft “Do Not Track” (“DNT”) standard of the World Wide Web Consortium (“W3C”) in their latest releases. As this standard has not been finalized, iwi’s Sites are not compatible with DNT and so do not recognize DNT settings. (d) Log Files.
As is true of most web sites, the Site server automatically recognizes the Internet URL from which you access the Site. We may also log your Internet protocol (“IP”) address, Internet service provider, and date/time stamp for system administration, order verification, internal marketing, and system troubleshooting purposes. (An IP address may indicate the location of your computer on the Internet.)
(e) Age.
We respect children’s privacy. We do not knowingly or intentionally collect personal information from children under age 13. Elsewhere on the Site, you have represented and warranted that you are either 18 years of age or using the Site with the supervision of a parent or guardian. If you are under the age of 13, please do not submit any personal information to us, and rely on a parent or guardian to assist you.
(f) Product Reviews.
You may choose to submit a product review. If you post a review, we will ask for your email address and geographic location. If you submit a review, your geographic location will be visible to other users (your email address will be kept private). Also, any personally identifiable information that you submit as part of the review can be read or used by other visitors to the Site. We are not responsible for any personally identifiable information that you choose to submit as part of your review. We believe you can post a helpful review without disclosing any personal information.
(g) Surveys & Contests
From time to time, our Website may request information from you in the form of surveys or contests. Participation in these surveys or contests is completely voluntary, and you may choose whether or not to participate and disclose the requested information. The information requested by these surveys or contests may include your contact information (such as your name and shipping address) and your demographic information (such as your zip code and age level).
The contact information you provide through our contests will be used by us to notify winners and award prizes. The information you provide through our surveys will be used by us to monitor and improve the use and satisfaction of our Website, as previously discussed above.
(h) Text Messaging
This Messaging Program Privacy Policy explains how iwi collects and uses information about you in relation to its text message marketing program (the “Messaging Service”). We use Klaviyo to provide the Messaging Service to you. For the purposes of the Messaging Service, Klaviyo acts as our service provider and data processor of your information.
We collect information about you, including information you directly provide when you use the Messaging Service. For example, we collect the phone number and/or email address you provided when signing up for the Messaging Service. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages.
We use your information to deliver, analyze, maintain and support the Messaging Service. We may also use your information to enhance the Messaging Service features and customize and personalize your experiences on the Messaging Service.
(i) Data Processors
We do not own or control any servers or databases. As a result, Personal Information is processed on our behalf by third party service providers. Because a number of the service providers we use are located in the United States, including certain iwi affiliates, your Personal Information may be processed and stored inside the United States, and the U.S. government, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your Personal Information under US laws. iwi's service suppliers adhere to the same protections regarding the collection, use, and retention of data as we do.
- Information Use and Disclosure
2.1. Generally.
- We do not disclose any Personal Information about you to any third parties except as stated in this Privacy Policy, as otherwise permitted by law, or authorized by you.
(b) Third parties to whom we disclose information are required by law and contractual undertakings to keep your Personal Information confidential and secure, and to use and disclose it for purposes that a reasonable person would consider appropriate in the circumstances, in compliance with all applicable legislation, which purposes are as follows:
(i) To provide the products and services you have requested from us;
(ii) To notify you or allow our affiliated companies to notify you of certain products or services offered by our affiliated companies;
(iii) For legal, claims settlement and valuation services;
(iv) To process transactions through data processing service providers; and
(v) If the information is a credit card number, to process credit card payments—through third party payment processing, clearing and settlement systems in association with various banks.
2.2. Internal Use.
We use your personal information to process your order and provide you with customer service. We may internally use your personal information to improve the Sites’ content and layout, to improve outreach and for our own marketing efforts (including marketing our services and products to you), and to determine general marketplace information about visitors to the Site. In order to facilitate such use and the other use described in this Section 2, we may share your information with affiliates under Qualitas Health, Inc.’s control.
2.3. Communications with You.
We will use your personal information to communicate with you about the Site and your orders and deliveries. Also, we may send you a confirmation email when you register or order with us. We may send you a service-related announcement on the rare occasions when it is necessary (for example, if we must temporarily suspend our service for maintenance.) Also, you may submit your email address for reasons such as to request us to notify you of new brands, new product styles, or product sizes; to sign up for email newsletters and special offers; or to sign up for a newsletter. If you submit your email address, we use it to deliver the information to you. We always permit you to unsubscribe or opt out of future emails (see the opt out section, below, for more details). Because we have to communicate with you about orders that you choose to place, you cannot opt out of receiving emails related to your orders.
2.4. External Use.
(a) We want to provide you with excellent service and to offer you a great selection. We do not sell, rent, trade, license or otherwise disclose your specific personal information or financial information to anyone other than to affiliates under Qualitas Health, Inc.’s control, except that:
(i) As do most catalog and Internet retailers, we sometimes use others to perform specific functions on our behalf. When we disclose information to these service providers, we disclose information to help them to perform their service. For example, in order to deliver products to you, we must share some information. We partner with third parties (such as the U.S. Postal Service, United Parcel Service, and Federal Express) to ship products, to ensure delivery, and so that we can obtain feedback, improve the quality of our service, and measure and improve the quality of the service of the third party. In the example of shippers, we provide them some personally identifiable information such as your name, shipping address, email, and phone number.
(ii) Similarly, to help you buy products and provide customer service to you, we must provide your credit card number to financial-services corporations such as credit-card processors and issuers. When we submit your credit card number for authorization, we use state-of-the-art data encryption to protect your information. (More on this below in Data Security.)
(iii) In the normal course of performing services for our clients, Personal Information may be shared within iwi and its affiliates for research and statistical purposes, system administration and crime prevention or detection.
(iv) iwi preserves the right to disclose without your prior permission any Personal Information about you or your use of this Site if iwi has a good faith belief that such action is necessary to: (a) protect and defend the rights, property or safety of iwi, employees, other users of this Site, or the public; (b) enforce the terms and conditions that apply to use of this Site; (c) as required by a legally valid request from a competent governmental authority; or (d) respond to claims that any content violates the rights of third-parties. We may also disclose Personal Information as we deem necessary to satisfy any applicable law, regulation, legal process or governmental request.
- LIMITING COLLECTION AND RETENTION OF PERSONAL INFORMATION
3.1. iwi will collect, use, or disclose Personal Information that is necessary for the Identified Purposes or as permitted by law. If we require Personal Information for any other purpose, you will be notified of the new purpose, and subject to your consent (where appropriate), that new purpose will become an Identified Purpose.
3.2. iwi will collect Personal Information by fair and lawful means. We will normally retain Personal Information as long as necessary for the fulfillment of the Identified Purposes. However, some Personal Information may be retained for longer periods as required by law, contract, or auditing requirements.
- CALIFORNIA PRIVACY RIGHTS
4.1. California Civil Code Section 1798.83 requires any operator of a website to permit its California-resident customers to request and obtain from the operator a list of what personal information the operator disclosed to third parties for direct marketing purposes, for the preceding calendar year; and the addresses and names of such third parties. iwi does not share any personal information collected from this site with third parties for their direct marketing purposes.
4.2. California Civil Code Section 1798.100 et seq. provides you with certain rights regarding our use and disclosure of your Personal Information, regardless of whether such information is collected by us through the iwi Online Properties or otherwise. While these rights are not absolute, you generally have the right to 1) unsubscribe from promotional and marketing communications, 2) opt out of our selling your information to third parties, and 3) request deletion of Personal Information when there is no longer a legitimate reason to keep it. You can exercise these rights as follows:
4.3. Receiving promotional emails or catalogs from us
If you no longer want to receive promotional emails (such as information about new products, special offers and sales events) or catalogs from us on a going-forward basis, you may “unsubscribe” from receiving such communications by: clicking the "unsubscribe" link in any promotional email; clicking the "unsubscribe" link available at promotional emails; or contacting us in accordance with the "Questions" section below. In each case, please remember that, if you wish to unsubscribe from receiving all promotional emails from iwi, you may need to unsubscribe separately with each iwi brand. When so contacting us, please be sure to include your full name and the email and/or postal address that you used when registering or making a purchase.
4.4. Our sharing of your Personal Information with Affiliates, Promotional Partners and other third parties for their marketing purposes:
If you no longer want us to share your Personal Information on a going-forward basis with our Affiliates, Promotional Partners and other third parties for their marketing purposes, you may opt-out of such sharing by contacting us in accordance with the "Questions" section below. In so contacting us, please be sure to include your full name and the contact information that you no longer wish to be shared, and state specifically whether you wish to opt-out of such sharing with (a) Affiliates, (b) Promotional Partners and other third parties, or (c) both. Additionally, we may need to ask for additional information in order to ensure that the Personal Information related to your opt-out request actually relates to you and not some other person.
4.5. Deletion of Personal Information
(a) If you no longer want us to retain your Personal Information on a going-forward basis, you may request deletion of Personal Information by contacting us in accordance with the "Questions" section below. In so contacting us, please be sure to include your full name and the contact information that you wish to be deleted, and state specifically whether you wish to opt-out of such sharing with (a) Affiliates, (b) Promotional Partners and other third parties, or (c) both. Additionally, we may need to ask for additional information in order to ensure that the Personal Information relating to your deletion request actually relates to you and not some other person.
(b) Please Note: there are a number of reasons which iwi will retain your Personal Data even if you make a deletion request. Generally these reasons are in order to defend a legal right or respond to a legal claim. However, applicable law also permits retention for our own internal business needs. If we decline to delete data after you have requested deletion, we will respond to you with our reasons, and explain how your Personal Information will still be protected so long as we retain it.
4.6. Access or Changing Your Personal Information.
We welcome your willingness to update your information with us. You may review or ask us to update your Personal Information by contacting us in accordance with the "Questions" section below. Further, you may ask for a copy of the Personal Information we have collected about you for the last 12 months. In your request, please make clear what information you would like to have changed. Additionally, we may need to ask for additional information in order to ensure that the Personal Information you are accessing actually relates to you and not some other person. We will try to comply with your request as soon as reasonably practicable. We are not responsible for changing information in the databases of Affiliates, Promotional Partners and other third parties with whom we have already shared your Personal Information. Note that you may not request copies of your Personal Information more than twice a year.
4.7. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out as described above, we will not be able to remove your Personal Information from the databases of our Affiliates, Promotional Partners and other third parties with which we have already shared your Personal Information (i.e., to which we have already provided your Personal Information as of the date that we implement your opt-out request). Please also note that if you do opt-out of receiving marketing-related messages from us, we may still send important administrative messages to you, and you cannot opt-out from receiving such administrative messages. For example, when you place an order, we will continue to confirm your order and shipment status by email. We may also need to contact you via telephone, email or postal mail with information or questions regarding your order.
4.8. Appointment of an Agent.
You have the right to appoint an agent to exercise all your rights under this Privacy Policy. However, appointment of an agent is a serious thing. As a consequence, we will require you to not only properly identify yourself and the information which relates to you, but we will require you to give iwi sufficient Personal Information about your agent so that we may identify them as well. We have a form you may fill out authorizing an individual agent to exercise your rights.
- SAFEGUARDS
We have in place physical, electronic and procedural safeguards appropriate to the sensitivity of the information we maintain. Safeguards will vary depending on the sensitivity, format, location, amount, distribution and storage of the Personal Information. They include physical, technical, and managerial measures to keep Personal Information protected from unauthorized access. Among such safeguards are the encryption of communications via SSL, encryption of information while it is in storage, firewalls, access controls, separation of duties, and similar security protocols. However, due to the nature of the Internet and related technology, we cannot absolutely guarantee the security of Personal Information, and iwi expressly disclaims any such obligation.
- EXTERNAL LINKS
iwi Sites may include links to other websites whose privacy policies we do not control. Once you leave our servers (you can tell where you are by checking the URL in the location bar on your web browser), use of any Personal Information you provide is governed by the privacy policy of the operator of the website you are visiting. That policy may differ from ours. If you can't find the privacy policy of any of these websites via a link from the website's homepage, you should contact the website directly for more information.
- ACCURACY, ACCOUNTABILITY, OPENNESS AND CUSTOMER ACCESS
7.1. Our knowing about changes to some of your Personal Information (e.g. email address) may be key to effectively communicating with you at your request. If any of your details change you can update us by e-mailing us at contact@iwilife.com. Please keep us informed of changes to your Personal Information.
7.2. You have the right to access your Personal Information and request rectification of any Personal Information in the file that may be obsolete, incomplete or incorrect. However, to secure your Personal Information, iwi does not provide online access to its customers to view or amend Personal Information in its database.
